You are responsible for compliance with any and all local laws applicable to your use of the site. Pesca-Ecuador makes no representations or warranties that materials contained on the site are appropriate or accessible from all locations.

By accessing the Site, you acknowledge and agree that your use of the Site is at your sole risk and that no party involved in creating, producing or delivering the Site is liable for any direct, incidental, consequential, indirect or punitive damages, or any other losses, costs or expenses of any kind (including attorneys' fees, expert fees or other disbursements) that may arise, directly or indirectly, through your access to, use of or browsing of the Sites or through your downloading of any materials, data, text, images, video or audio from the Sites, including but not limited to anything caused by any computer virus, errors, human action or inaction or any computer system, telephone line, hardware, software or program malfunctions, or any other errors, failures or delays in computer transmissions or network connections.

The purpose of these Terms and Conditions of Purchase is the supply by Pesca-Ecuador of the products offered in its online store, in exchange for a financial benefit.

By accessing our portal, the Client agrees to respect the Terms and Conditions as well as the rules of use that appear therein.

Fifth

These Terms and Conditions, together with the order confirmation, constitute the contract between Pesca-Ecuador and the Client for the supply of the products. No other texts will apply.

It will be understood that the Client agrees with the general conditions provided in this text from the moment that he accepts that he has read and agrees with these Terms and Conditions and does not expressly express his disagreement.

Sixth

In order to place an order, the Customer must be at least 18 years of age. If the Customer is a minor, he/she must ask his/her parents or legal guardians to place the order on his/her behalf.

If the Customer is a minor, please do not provide us with any personal information, as we cannot accept it.

Once he/she has accessed the online store, the Customer must fill out the form with the necessary personal data requested in our online store and click on the ‘Complete order’ button to confirm the purchase.

Seventh

In the event of a problem with the delivery of the goods, we will contact the Customer as soon as possible to inform them of the situation and suggest alternative products that they may wish to purchase or to wait for the goods to be replenished by our suppliers. We will also propose to refund the sum of money that they have paid us for such goods.

The Customer may cancel the order at any time and at no additional cost, provided that it has not been invoiced and sent by the transport company. If the package has left our facilities, the return will not be accepted.

The availability of products on the website changes constantly and reflects the situation in real time. Adding an item to the shopping basket does not guarantee that it will be reserved for the Customer, as other customers may have purchased it while they were browsing the website. Only when the payment process has been completed, the product is effectively reserved for the Customer.

We will make every effort to supply the products listed in your order confirmation. However, there may be occasions where we are unable to supply such products due to, for example, the products being out of stock. In such cases we will contact the Customer to inform them and may suggest alternative products that they may wish to purchase.

Eighth

The price of each product will be clearly stated in the online store. The price and conditions of the products offered may vary over time, but in any case, for a specific order, the price and conditions that were indicated when the Customer placed the order will always apply.

The final price of the products in the cart is broken down into: Price of the Item plus the corresponding VAT tax.

Shipping costs are not indicated in the price of the products. Shipping costs are the responsibility of the Customer and will be added to the total amount of the selected products. The Customer can check the amount of shipping costs at any time in the shopping cart, before confirming the order and completing the contracting process. The calculation of shipping costs depends on the shipping area and the material added to the cart.

Ninth

If our security department suspects any anomaly or fraud, Pesca-Ecuador reserves the right to cancel the transaction for security reasons.

Our main payment methods are Credit/debit cards, Bank transfer or deposits. Please note that the payment methods offered may vary depending on the destination country. Once all items have been added to the basket and you have already selected the courier service, all the payment methods available for your destination country will be displayed.

For online payments made by credit/debit card, the ‘Secure Socket Layer’ (SSL) security system is used, which allows banking information to be encrypted on the network.

Tenth

In case the package cannot be delivered due to any reason, such as incorrect address, absent recipient, package rejection, etc., the package will be returned to our warehouse. Please note that we can only refund the price of the product paid, once the package has arrived back to our warehouse. The Customer will receive a refund of the price of the product paid by the same payment method used when placing the order, but the shipping costs will not be refunded.
